Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Ninebind Inventory Management (the “Service”). By browsing, creating an account, submitting a buylist, or placing an order, you agree to these Terms. If you do not agree, do not use the Service.
1. Service description
The Service provides an online catalog of trading-card singles and sealed products, customer-account features, a buylist submission workflow, and an inventory-backed checkout. Payment processing, order capture, and the customer-account portal are operated on our behalf by Shopify; orders placed on the Service are subject to the additional terms of Shopify’s hosted checkout.
2. Eligibility
You must be at least 13 years old to create a customer account. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or guardian who agrees to be bound by these Terms on your behalf.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at noreply@ninebind.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms.
4. Orders, pricing, availability
Listed prices and availability are subject to change without notice. We reserve the right to cancel any order that contains a pricing or stock error; in that case, any payment captured for the affected items will be refunded. Buylist quotes are estimates based on the condition you reported and the market data we held at the time of submission; final acceptance and payout amount depend on staff inspection of the physical cards.
5. Acceptable use
You agree NOT to:
- place fraudulent orders, submit fake buylist offers, or use a stolen payment instrument;
- attempt to resell, transfer, or redeem digital codes or sealed product outside the channels Shopify provides for that purpose;
- scrape, mirror, or otherwise programmatically extract our catalog or pricing data without prior written permission;
- interfere with the operation of the Service, including by probing for vulnerabilities, overloading our infrastructure, or attempting to bypass authentication;
- upload or transmit unlawful, infringing, or harmful content via any submission field (buylist notes, customer profile, etc.).
6. Intellectual property
The Service, including the software, catalog presentation, and brand assets, is owned by us or our licensors. Card images, set symbols, and oracle text are property of their respective rights holders (Wizards of the Coast for Magic: The Gathering; The Pokémon Company for Pokémon) and are used here for the purpose of identifying products for sale.
7. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOST GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY.
9. Force majeure
We are not liable for any failure or delay in performance to the extent caused by events beyond our reasonable control, including natural disasters, war, civil unrest, governmental action, pandemic, labor disputes, or interruptions in third-party services (Shopify, payment processors, shipping carriers).
10. Dispute resolution
Before initiating any formal proceeding, you agree to first contact us at noreply@ninebind.com and attempt in good faith to resolve the dispute informally for at least thirty (30) days. If informal resolution fails, the parties agree to attempt mediation in Ontario, Canada, before commencing litigation. Each party bears its own mediation costs.
11. Governing law and jurisdiction
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict-of-laws principles. Subject to Section 10, the courts located in Ontario have exclusive jurisdiction to resolve any dispute arising out of or relating to these Terms.
12. Changes to these terms
We may modify these Terms from time to time. Material changes will be announced on the storefront at least thirty (30) days before they take effect; continued use of the Service after the effective date constitutes acceptance.
13. Termination
You may terminate your account at any time by requesting deletion from your account privacy page. We may suspend or terminate access for violation of these Terms with or without notice. Sections that by their nature should survive termination (Sections 6–11) will so survive.
